Settlement would end civil rights complaint related to North Port Police dog bite

NORTH PORT – The North Port City Commission will be asked to approve a $130,000 settlement agreement with Matthew C. Poulin that would end a federal civil rights complaint for excessive force from an October 2017 arrest when Poulin was bitten three times by a police dog after he was tased three times.

The agreement, which is on the consent agenda for Tuesday’s North Port City Commission meeting, must be approved because it exceeds a $100,000 ceiling for settlements.

The funds would be paid by the city’s “excess carrier” for claims.

Basis for the civil rights case against the North Port Police

North Port Police Officer and K-9 handler Chad Walker is facing a federal civil rights complaint for excessive force, while five other officers Keith Bush; Matthew Lagarce, John Contorno, Stephen Cambria and Sgt. John “Mike” Hetteberg faced complaints for failure to intervene in the Oct. 17 incident.

Walker’s complaint was related, in part, to the opinion of U.S. District Court Judge William F. Jung, who had reviewed several available videos – including a dash cam video that showed Poulin meandering and stumbling, as well as tripping prior to making contact with Walker. Jung determined that by the time Walker released Dutch to bite Poulin, “the need for force was significantly diminished.”

“Mr. Poulin, still unarmed, was sitting upright in the small gully next to the parked trailer with his legs spread before him as five police officers stood on higher ground to his right,” Jung wrote. “As an initial matter, the use of a K-9 on a stationary, contained, and unarmed suspect represents a significant increase in force from the use of a taser.”

A pattern of excessive force for North Port Police

The incident happened late in the tenure of former North Port Police Chief Kevin Vespia and was the last in a series of incidents that prompted four other federal lawsuits filed against the city of North Port citing excessive force because of K-9 bites.

A year-long investigation conducted by the Herald-Tribune that was published in July 2015 found that North Port K-9 handlers commanded their dogs to attack more people from 2010 through 2014 than the K-9 handlers in the neighboring municipalities of Sarasota, Bradenton, Palmetto, Venice and Punta Gorda combined.

What the settlement means for North Port

Should the city commission approve the settlement, that would end the complaint against the six officers, five of whom are still employed by the city of North Port.

The sixth, Bush, is now a detective with the Manatee County Sheriff’s Office.

K-9 Dutch retired earlier this year.

I stayed up all night so I would be awake when you got here.  I am going to have to postpone the appointment John, as I did tell you I was a diabetic and stuff like this screws up my sugar / glucose levels.  Look up Cortisol, all have it however when you are on insulin it can spike your levels to over 350 which since I know you were not a aware of the EGF in urine or the glomerular filtration rates, but your kidney don’t die but any level above 250 your kidneys stop filtering the glucose and it backs up in your body.

I am going to sleep now in about 19-27 minutes as the moment the Walmart order hits our house, I will be in la la land.

Please try to reschedule for another day.  I am so glad that I did not cancel the other guy coming at noon on Tuesday.

I may call you back or not on Tuesday night if the other guy does not show up at noon.

But if I do then I will be doing my damndest to get another plumber to show up at the same time as you. Whoever plans for the shit to hit the fan and can come early will get my money.

However, I was looking you up on Sun Biz, the site where every licensed plumber is required to be registered in Florida.  I also looked you up on the department of finance and regulation in the state of FLORIDA, and you are not there either, and I also looked up if you had the proper insurances and it seems that you do not John.

It seems that you are a ghost.  Then when I looked you up on my phone plus using those NIFTY PRESS PASSES THAT I HAVE, JOHN, I found out that you are John Wilcox, but after I spent an hour speaking with another JOHN WILCOX, not to call you a liar, but the other John Wilcox has been a licensed plumber for many years (see at bottom)

and he did not like that there might be an UNLICENSED IMPOSTER DOING WHAT HE EARNED THE RIGHT TO do as a licensed PLUMBER.

I am sure that there you have an HONEST EXPLANATION FOR ALL OF THIS, BUT JUST, in case when AMAZON WAS SELLING gallons of water for over $30 a gallon the FLORIDA ATTORNEY GENERAL was quite happy that I brought that to their attention which selling water for that price in normal situations is quite legal however within a week of a natural disaster like HURRICANE IAN, or any upheaval like that, selling water a basic necessity and gouging people is a CRIMINAL ACT WITH REAL JAIL TIME, and although AMAZON WAS NOT HELD RESPONSIBLE every one of the idiots that sold water to gouge people either got a fine or went to JAIL, JOHN.

Remember John, when I said well I didn’t say it beside having court orders that SPECIFY THAT I AM NOT A PHYSICAL DANGER TO MYSELF OR ANYONE or another NIFTY COURT ORDER THAT SPECIFIES THAT I DO NOT HAVE THE LEGAL REQUISITE ABILITY TO FORM THE LEGAL INTENT TO GET ANGRY, which means normally when i say have a nice day, it means something else, John.
