Advertising Review:
In June 2020, Better Business Bureau challenged US Home Guard’s marketing mailer. The mailer stated:
- “TIME SENSITIVE”
- “IMMEDIATE RESPONSE TO THIS NOTICE REQUESTED”
- “Respond By: 3/18/2020”
- “Call to verify the above information Before the respond date expires!”
- “IMMEDIATE RESPONSE REQUESTED”
- EXTREMELY URGENT
- “Please call IMMEDIATELY as this will be our FINAL ATTEMPT TO NOTIFY YOU…”
- “Customer ID:”
- “We reserve the right to revoke your eligibility for service coverage after 5 days.”
- “Our records indicate that you HAVE NOT CONTACTED us yet to get your Home Warranty up to date.”
- Without a home warranty in place, you are at risk of being financially liable for any and all repairs. However, you still may have time left to activate a Warranty on your home before it’s too late. No inspection will be required and final acceptance is subject to your ability to meet eligibility requirements.”
According to BBB Code of Advertising, “The primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any objective claims or offers made before publication or broadcast. Upon request, they should present such substantiation promptly to the advertising medium or BBB. Advertisements which are untrue, misleading, deceptive, fraudulent, falsely disparaging of competitors, or insincere offers to sell, shall not be used. An advertisement as a whole may be misleading by implication, although every sentence separately considered may be literally true. Misrepresentation may result not only from direct statements, but by omitting or obscuring a material fact. In addition, according to the Missouri state statute 15 CSR 60-7.020 (1): “A seller shall not make a representation or statement of fact in an advertisement that is false or has the capacity to mislead prospective purchasers.”
BBB asked the business to provide substantiation to the claims made on its marketing mailer. The company responded that the sense of urgency is to help avoid homeowners that have pre-existing conditions. BBB informed business that the claim, “Our records indicate that you HAVE NOT CONTACTED us yet to get your Home Warranty up to date.” is considered to have the capacity to mislead. The business responded that its position is that the statement is a true statement and, the business makes an effort to reach out to consumer as many times as they can through technology solutions. Further, the mail piece is their final effort to reach consumers and, by that point, the consumer has not contacted them.
